Energy Tax Update: The "One, Big, Beautiful Bill"

On Friday, May 16, Orrick’s Energy Tax Team hosted a webinar discussing the proposed tax bill (“The One, Big, Beautiful Bill”) released by the Committee on Ways and Means on May 12. The team provided an overview of key aspects of the bill as they related to the renewable energy sector, including revised ITC and PTC qualification requirements, impact on transferability and newly proposed phase-out schedules. They discussed how these changes may affect project financing, the development pipeline, tax credit sales and overall market dynamics.

He helps clients structure financings for their projects to take advantage of federal and state tax incentives, like the Federal production tax credit (PTC), energy investment tax credit (ITC) and accelerated depreciation (MACRS and “bonus”) using partnership flips, sale-leasebacks, public/private partnerships, and other structuring options. He has been particularly focused on providing clients with the latest guidance and opportunities relating to the Inflation Reduction Act, including with respect to Section 6418 tax credit transfers and Section 6417 direct pay opportunities.
